SUMMARY NO. 25121 ORDINANCE NO. 25712

On motion of Mr. Templet, seconded by Ms. Lee-Sheng, the following Ordinance was offered:

 SUMMARY NO.  25121 ORDINANCE NO. 25712

An ordinance creating a neighborhood improvement and beautification district to be known as the “Timberlane Neighborhood Improvement and Beautification District, Parish of Jefferson, State of Louisiana”; fixing boundaries thereof; providing for its governance, powers and duties; and providing for related matters. (Council District 1)

WHEREAS, the Jefferson Parish Council (the “Council”) has been requested by residents of the Timberlane Estates Subdivision to create a special neighborhood improvement and beautification district on the West Bank of Jefferson Parish (the “Parish”) as set forth herein, for the purpose of promoting and encouraging the improvement, beautification and overall betterment of Timberlane in order to add to the quality of life of the residents thereof by maintaining property values, increasing the tax base, fostering economic growth and providing for recreational activities; and  

WHEREAS, under authority of the provisions of Article 6, Section 19 of the Louisiana Constitution of 1974, Section 2.01 (7) of the Jefferson Parish Home Rule Charter and House Bill No. 785 of the Regular Session of the Louisiana Legislature for the year 2016, enacted as R.S. 33:9099.3 (the “Act”), the Council deems it advisable, necessary and in the public interest of the residents of Timberlane to create a special neighborhood improvement and beautification district for the purpose of promoting and encouraging the improvement, beautification and overall betterment of Timberlane in order to add to the quality of life of the residents thereof by maintaining property values, increasing the tax base, fostering economic growth and providing for recreational activities, which district shall be comprised of and include all of that territory as set forth herein; and

WHEREAS, the provisions of the Act further provide that the Council shall by Ordinance create the special neighborhood improvement and beautification district and therein provide for the name, boundaries, governance, powers and duties of the special district. 

 NOW, THEREFORE, the Council, acting as the governing authority of the Parish of Jefferson, State of Louisiana, hereby ordains:

SECTION 1.  Under and by virtue of the authority conferred by Article 6, Section 19 of the Louisiana Constitution of 1974, Section 2.01(7) of the Jefferson Parish Home Rule Charter and the Act, a neighborhood improvement and beautification district be and is hereby created within the Parish to be known as the “Timberlane Neighborhood Improvement and Beautification District, Parish of Jefferson, State of Louisiana” (the “District”), which shall comprise and embrace all of that territory within the boundaries which are described as follows:

  1. Parcel “A” of Belle Meade Subdivision (portion of Section “C”, Oakdale Subdivision, Jefferson Parish), as shown on the survey of Adloe Orr Jr. & Associates, dated October 8, 1970 and referenced in COB 724, folio 33, et seq. of the records of the Parish of Jefferson, LA.
  2. Property situated north of Lapalco Boulevard, bounded to the north by Belle Chasse Highway, to the east by Timberlane Drive, to the west by the Verret Canal, and to the south by Lapalco Boulevard, less and except:
    1. Parcel “A” Oakdale Subdivision, Section “C”, fronting on Belle Chasse Highway and originally re-subdivided into Lots 10 through 33 along with the dedication of Enterprise Drive - as shown on the survey by J. J. Krebs & Sons, Inc., dated October 2, 1975;
    2. Parcel “A” Oakdale Subdivision, Section “C”, consisting of Lots 24-B, 23, 32, 33, and a portion of Plot A, Industrial Site #1, Section C, Oakdale Subdivision, designated as Lot A-6 (all comprising municipal number 1620 Belle Chasse Highway, Gretna, LA). Said property is described in Act of Capital Contribution, dated June 8, 2001, passed before Roy J. D. Gattuso, N. P., and recorded in the records of the Parish of Jefferson as Act No. 10131211.
    3. Lot Z, Square 2, Oakdale Industrial (1700 Belle Chasse Highway, Gretna, LA);
    4. Lot 16, Square C, Timberlane Estates, Unit 6 (1820 Belle Chasse Highway, Gretna, LA); 
    5. Lot 17, Square C, Timberlane Estates, Unit 6 (1888 Belle Chasse Highway, Gretna, LA);
    6. Lot A-5-A, Square 1, Oakdale (216 Fairfield Avenue, Gretna, LA);
    7. Lot A-4-B, Oakdale (228 Fairfield Avenue, Gretna, LA);
    8. Lot 8, Square 2, Oakdale (237 Fairfield Avenue, Gretna, LA);
    9. Lot BB Oakdale (240 Fairfield Avenue, Gretna, LA);
    10. Lot 7, Square 2, Oakdale (241 Fairfield Avenue, Gretna, LA);
    11. Lots 5 & 6, Square 2, Oakdale (245 Fairfield Avenue, Gretna, LA); and
    12. Lot AA, Section C, Oakdale (250 Fairfield Avenue, Gretna, LA).
  3. Property situated south of Lapalco Boulevard, bounded to the north by Lapalco Boulevard, to the east by the rear lot lines of the properties located on the east side of Marlene Drive, to the west by the Verret Canal, and to the south by Bayou Fatma. Said property includes the land and improvements at municipal address 820 Fairfield Avenue, Gretna, LA.

SECTION 2. The District, as thus created, shall constitute a special taxing district and political subdivision of the State of Louisiana, and it shall have all of the powers and privileges granted by the Constitution and Statutes of the State of Louisiana to such subdivisions, including the authority to incur debt, to issue bonds and to levy and collect taxes, special assessments and fees, upon a majority vote of the electorate of the District; to issue certificates of indebtedness; and including the authority to acquire property located within the boundaries of the District; and the District shall have full power and authority to perform any function it deems appropriate, incidental and necessary for achieving the purposes of the District; however, the District shall not be authorized to acquire property by expropriation. 

SECTION 3.  The District shall be governed by a Board of Commissioners (the “Board”) consisting of five (5) members, chosen as follows:

  1. The president of the Timberlane Estates Improvement Association (the “TEIA”) shall be a Board member ex officio and shall serve for a term of one (1) year to coincide with his/her term as TEIA president.
  2. The property owners of the properties comprising the Timberlane Neighborhood Improvement and Beautification District shall elect four members at-large, whose terms shall be staggered as follows: 
    1. At the initial election, the two highest vote recipients shall serve two-year terms; and the next two highest vote recipients shall serve one-year terms. 
    2. In all subsequent elections, the highest two vote recipients running for open seats shall be elected to two-year terms.
  3. Each property within the Timberlane Neighborhood Improvement and Beautification District is afforded one ballot for the election of District commissioners.  If a property is owned by a partnership or corporation, the ballot shall be executed by the individual designated by resolution of the partnership or corporation, and the resolution shall be attached to the ballot. If a property is owned by a Trust, an estate or is under succession administration, the ballot shall be executed by the duly appointed Trust, estate or succession representative; and a certified copy of the document evidencing such appointment shall be attached to the ballot.
  4. All members of the Board shall be members of the Timberlane Estates Improvement Association, shall own property within the District, and shall be qualified electors registered in the District.

SECTION 4.  The domicile of the District shall be and is designated as the Office of the Parish Clerk, Sixth Floor, General Government Building, Gretna, Louisiana; the official seal of the Parish be and the same is hereby adopted at the official seal of the District; and the official journal of the Parish be and the same is hereby designated as the official journal of the District.

This Ordinance having been submitted to a vote of the Parish Council acting as the governing authority of the Parish of Jefferson, State of Louisiana, the vote thereon was as follows:

YEAS: 7 NAYS: None ABSENT:   None 

The Ordinance was declared adopted by the Jefferson Parish Council acting as the governing authority of the Parish of Jefferson, State of Louisiana on this the 5th day of December, 2018, and shall become effective as follows:  if signed forthwith by the Parish President, ten (10) days after adoption, thereafter upon signature by the Parish President or, if not signed by the Parish President upon expiration of the time for ordinances to be considered finally adopted without the signature of the Parish President, as provided in Section 2.07 of the Charter.  If vetoed by the Parish President and subsequently approved by the Council, this Ordinance shall become effective on the day of such approval.
